How Texas child support is calculated
Texas uses guideline child support (Texas Family Code, chapter 154). The court starts from the paying parent's monthly net resources: wages, self-employment income and most other income, minus Social Security, Medicare and federal income tax (calculated as a single filer), union dues, and what that parent pays for the children's health and dental insurance.
A percentage of net resources is then applied, based on the number of children:
| Children in the case | Percentage of net resources |
|---|---|
| 1 | 20% |
| 2 | 25% |
| 3 | 30% |
| 4 | 35% |
| 5 | 40% |
| 6 or more | Not less than 40% |
- Other children: when the paying parent also supports children outside the case, the percentages are lower. This calculator uses the multiple-family tables.
- Low income: when net resources are below $1,000 a month, a lower set of percentages applies.
- Cap: the percentages apply to net resources up to the guideline cap, currently $11,700 a month. Above that, a court can order more based on the children's proven needs.
- Medical and dental support: courts also order health and dental coverage for the children. Those amounts are separate from the guideline amount shown here.
- A court can vary from the guidelines when applying them would be unjust or inappropriate.
Estimate only, not legal advice. A court can order a different amount based on the evidence, other deductions, medical and dental support, and its findings.
